What’s Usually in a Severance Agreement — and What You’re Giving Up
Most severance agreements include a release of all legal claims against your employer. Once you sign, those claims are gone. Here is what we look for before any client puts pen to paper.
- A broad release waiving discrimination, retaliation, and wage claims
- Non-disparagement clauses that restrict what you can say publicly
- Non-compete or non-solicitation terms buried in the agreement
- Confidentiality provisions that limit your ability to discuss the termination
- Clawback language tied to unemployment or future employment
- Inadequate consideration for the rights you are being asked to waive
We Review, Advise, and Negotiate
We work with employees who have received severance offers and want to understand their options. In many cases, there is room to negotiate — especially where a potential legal claim exists.
Agreement Review
We read the full agreement and flag provisions that are unusual, one-sided, or that may limit your rights beyond what is standard.
Leverage Assessment
If you have a potential legal claim — discrimination, retaliation, wage violations — that changes the negotiating picture. We help you understand where you stand.
Negotiation Support
Where there is room to push, we push. Higher severance, modified terms, or removal of restrictive covenants — results vary, but we identify what is achievable.
A note on fees: If we identify a viable legal claim and take your matter on contingency, there is no fee unless we recover additional money for you. Not every severance matter involves a legal claim — we will be straightforward with you about your options from the start.
